Probably not, but codes vary by city. You might actually be classified as a manufacturer. If you make over $600, you need to pay taxes on it. It doesn’t cost that much to incorporate through the Secretary of State in your state. It can be advantageous in getting business loans and protecting your business name.

If you use a different name than your own, you may need to file with the county clerk. You’d file an “assumed name” notice. There’s usually no one looking over your shoulder on that type of thing, but it can be good to do it and get it out of the way.

If you are incorporated through the state, you shouldn’t have to file an assumed name notice.

But you could probably go years without doing any of that and no one would even know.
